CHARLES M. BLACK, JR. Prior to joining Payne & Black, LLC, CHARLES M. BLACK, JR. was Assistant General Counsel with the South Carolina Department of Health and Human Services (DHHS), the agency which administers the South Carolina Medicaid Program. He was primarily responsible for program-related issues such as recipient eligibility, program development, and provider enrollment. He also represented the agency in administrative appeals at all levels of the process. Mr. Black is experienced in such areas as hospital and physician services, home and community-based services, nursing homes and home health, and managed care. His duties also included research and drafting of appropriate legislation, policies, procedures, and program bulletins in order to effectively implement programs. He also participated in contract negotiations, reimbursement matters, and enforcement/recoupment actions. Mr. Black received his JD from the University of South Carolina School of Law in 1987, and earned a Bachelor of Science degree (double major in finance and management) from the University of South Carolina's College of Business Administration in 1984. He is a member of both the South Carolina Bar and the Florida Bar (currently inactive), as well as the American Health Lawyers Association. Also shareholder in Elder Law Services of SC, P.A.

MITCHELL C. PAYNE is a Partner in the law firm of Payne & Black, LLC with offices in Rock Hill and Columbia, South Carolina and a Shareholder of Elderlaw Services of South Carolina, P.A. With Jan Warner, he co-founded Elder Law Services of South Carolina, P.A.  Mr. Payne received his Masters in Accounting from the University of South Carolina’s Moore School of Business in 1981, and his JD from the University of South Carolina School of Law in 1984, where he served on the SC Law Review. Mr. Payne concentrates his practice in the fields of Elder Law, Long Term Care Planning, Medicaid Eligibility, Nursing Home Law, Estate Planning, Disabilities and Special Needs Law, Asset Protection Planning, Probate, Estate Administration, Incapacity,  Bankruptcy Law.  Mr. Payne is a Member of the National Academy of Elder Law Attorneys,  and a Charter Member of the Academy of Special Needs Planners.  He is a founding board member and past Chair of The Carolina's Chapter of the National Academy of Elder Law Attorneys, Past President of the South Carolina Chapter of NAELA, and past Chair of the Elder Law Committee of the South Carolina Bar.  Mr. Payne is a frequent lecturer on Long Term Care Planning, Medicaid, Disabilities, Asset Protection, and Elder Rights issues.  Mr. Payne is a member of the South Carolina and Georgia Bar.
